Terms & Conditions
Prices
All goods will be invoiced at prices ruling at the date of despatch. Prices are subject to change without prior notice. All prices are net of any discount.
Value Added Tax (VAT)
Terms are net of VAT(unless otherwise stated), VAT will be levied on all items where
appropriate and shown separately when invoiced. VAT exemption claims (where applicable)
should be made with a supporting certificate at the time of order.
Carriage and Small Orders
All orders over £75 (ex VAT, net of discounts) are carriage paid to UK destinations
with the exception of offshore islands, Northern Ireland and parts of Scotland.
Orders under £75 (ex VAT,net of discounts) are subject to a small order handling/carriage
charge of £7 (exVAT). Delivery to be in accordance with instructions but no liability
will be accepted for loss through delays however caused.
Cancellations
Notifications of a cancelled order shall only be valid when given in writing and
agreed by Hillside Medical Supplies Ltd. If written notification is received Hillside
Medical Supplies Ltd reserves the right to charge for cancellation up to 25% of
the amount of the order (ex VAT , net of discounts).
Installation
Where the seller agrees to install and /or affix the product for the buyer then
the seller shall be under no liability whatsoever for any loss or damage, whether
direct or consequential and however so arising caused to the buyer or any third
party during or as a result of installation.
Payment
Payment is due strictly 30 days from date of invoice(unless otherwise agreed) if
an account has been established. Payment should be made payable to Hillside Medical
Supplies Ltd, 7 Glenholme Park, Brunel Drive, Newark Notts NG24 2EG. We reserve
the right to charge interest on all overdue accounts at a rate of 2% a month on
outstanding balance.
Title of Goods
All risk in the goods shall pass to the buyer but the beneficial title of goods
does not pass to the purchaser until payment in full for the goods has been received
by Hillside Medical Supplies Ltd. Until the date of such payment the buyer will
hold the goods in a fiduciary capacity for Hillside Medical Supplies Ltd that in
the event of prior resale Hillside Medical Supplies Ltd shall be entitled in law
and equity to the proceeds of such sale or on any claims for the sale. The buyer
shall at the request of Hillside Medical Supplies Limited’s request store the goods
in such a way that they are clearly shown to be the property of Hillside Medical
Supplies Ltd.
Goods
All orders for goods are accepted subject to the availability of raw materials ,
components and labour.
Claims for Damages and Shortages
If goods are received damaged they should be signed for as such. All claims should
be made in writing within 3 working days of receipt of goods which allows us to
make a subsequent claim on our carriers. Shortages (number of parcels) should be
signed for as such and notification given to us within 3 working days. Claims after
this period may not be accepted. Goods should not be returned without prior authorisation.
Liabilty for Shortages
The liability for shortage, failure or defect of the goods supplied shall be limited
to the cost of making good any such shortage, failure or defect. We will not accept
any consequential losses.
Non Account Holders
Goods can be supplied on cash, cheque , against a proforma invoice with any order
or by credit or debit card.
Dispute
If a dispute should arise, all matters concerning the contract are to be construed
according to English Law. If goods are subject to any dispute or have been tendered
for or delivered but not paid for Hillside Medical Supplies Ltd may require the
dispute to be referred to arbitration. The arbitration of a person should be mutually
agreed on, or failing such agreement at the request of Hillside Medical Supplies
Ltd a person will be appointed by the Chartered Institute of Arbitrators and should
be made within 14 days of both parties being aware of the dispute.
Insolvency
If the buyer becomes insolvent or compounds with its creditors or acts in such a
way which affects their ability to pay for goods, Hillside Medical Supplies Ltd
reserve the right to collect the goods which have already been delivered or stop
those in transit.
Acts of God
All quotations, products supplied and contracts entered into are free of all liability,
which may be caused by circumstances beyond the control of Hillside Medical Supplies
Ltd, including Acts of God, Fire, Government control, Accident, Strikes, Lock outs
and other similar circumstances.
